Terms of Service

These Terms of Service (“Terms”) govern access to the plantrack.app website, web application, mobile applications, and related PlanTrack services (together, the “Service”) provided by:

ETB Studio LLC
1401 21ST ST, STE R
SACRAMENTO, CA 95811, USA

By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use PlanTrack.

1. Eligibility

You must be at least 16 years old. If the law where you live does not allow you to enter into this agreement independently, you may use PlanTrack only with permission from a parent or legal guardian.

You represent that you have authority to accept these Terms and are not prohibited from using the Service under applicable law.

2. Your account

Most features require an account. You agree to provide accurate information, keep it current, and protect your login credentials.

You are responsible for activity through your account, except for activity occurring after you promptly notify us of unauthorized access. You may not transfer an account, impersonate another person, or create accounts to bypass restrictions.

We may ask you to verify your email address, identity, or authority over an account.

3. What PlanTrack provides

PlanTrack helps connect life domains, goals, plans, tasks, and reviews. The Service provides organizational and analytical tools but does not guarantee that you will achieve a goal or obtain a particular result.

PlanTrack is not a substitute for medical, mental health, legal, financial, or other professional advice. You remain responsible for decisions based on plans, statistics, or AI output.

4. Your content

You retain ownership of goals, tasks, notes, attachments, messages, and other content you create.

You grant ETB Studio LLC a limited, non-exclusive license to host, process, copy, transform, and transmit that content only as needed to operate, secure, support, and improve the Service. This license ends when the content or account is deleted, except for backups and information we must retain by law.

You represent that you have the right to upload your content and that it does not violate law, third-party rights, or these Terms.

5. AI features

The AI coach may generate responses and proposals using context you provide. AI output is generated automatically and may be inaccurate, incomplete, outdated, or unsuitable for your circumstances.

Review AI output before relying on it. Changes proposed by the coach require your confirmation, but you remain responsible for the decision and resulting content.

Do not use AI features to make high-impact decisions concerning a person’s health, safety, legal rights, finances, or employment.

6. Acceptable use

You may not:

  • violate law or the rights of another person;
  • upload malicious code or attempt to compromise the security or availability of the Service;
  • access another user’s account or information;
  • scrape data, create excessive automated load, or bypass technical restrictions;
  • copy, reverse engineer, or attempt to extract source code except where expressly permitted by law;
  • use PlanTrack for spam, fraud, harassment, or unlawful content;
  • resell or provide the Service to third parties without written permission.

We may restrict access, remove prohibited content, or suspend an account while investigating a violation.

7. Third-party services

PlanTrack may interact with third-party services such as Google Sign-In, reCAPTCHA, app stores, and AI providers. Their own terms and policies govern processing they perform as independent providers.

We are not responsible for third-party websites and services that ETB Studio LLC does not control.

8. Changes and availability

We may add, change, temporarily disable, or discontinue PlanTrack features. Mobile applications and new capabilities may be released in stages, so feature sets can differ between platforms.

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, network failures, third-party outages, and other interruptions may occur.

If paid features are introduced, the price, subscription period, renewal, and refund terms will be shown before purchase and may also be governed by app-store terms.

9. Intellectual property

The Service, software, design, trademarks, and PlanTrack materials belong to ETB Studio LLC or its licensors. These Terms give you a limited, revocable, non-transferable right to use the Service for personal or internal business purposes.

No rights are granted except those expressly stated in these Terms.

10. Suspension and termination

You may stop using the Service and request account deletion at any time.

We may suspend or terminate access if you materially violate these Terms, create risk for the Service or other users, or if required by law. Where reasonable, we will give notice and an opportunity to cure the violation.

Provisions that by their nature should survive termination, including intellectual property, warranty disclaimers, and limitations of liability, will remain effective.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” ETB Studio LLC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of results.

Some jurisdictions do not allow certain warranty disclaimers, so part of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, ETB Studio LLC and its related persons will not be liable for indirect, incidental, special, exemplary, or punitive damages, or for lost profit, data, goodwill, or opportunity arising from use of or inability to use the Service.

ETB Studio LLC’s total liability for claims relating to the Service will not exceed the greater of US $100 or the amount you paid for PlanTrack during the 12 months before the event giving rise to the claim.

These limitations apply only to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless mandatory law requires otherwise, disputes will be heard in the state or federal courts located in Sacramento County, California, and the parties consent to their jurisdiction.

Before filing a claim, the parties will attempt in good faith to resolve the dispute. Begin by sending a description of the issue to support@plantrack.app.

14. Changes to these Terms

We may update these Terms. A new version will be posted on this page with a revised date. We will provide additional notice of material changes. Continued use after an update takes effect means that you accept the revised Terms.
